Upbeat Performing Arts Academy ("Upbeat," "we," "us," or "our") respects your privacy and is committed to protecting the personal information of our students, parents/guardians, and website visitors. This Privacy Policy explains what information we collect, how we use it, and the choices you have.
By using our website (the "Site") or registering for our programs, you agree to the practices described in this Privacy Policy.

3. Information About Minors
Many of our students are minors (ages 5–18). We collect student information only with the consent of a parent or legal guardian through the registration process. Parents/guardians are responsible for the accuracy of information submitted on behalf of their student.
We do not knowingly collect personal information directly from children under 13 through the Site itself (e.g., children are not expected to fill out our Contact or registration forms unsupervised). All registration and enrollment is completed by a parent or guardian.
If you believe a child has provided us with personal information without parental consent, please contact us at upbeatmusicgroups@gmail.com and we will take steps to delete it.
4. Photo, Video, and Media Release
Upbeat regularly shares photos and videos of classes, rehearsals, and performances on our website and social media channels (Facebook, Instagram, YouTube, X, LinkedIn, TikTok) for promotional and educational purposes.
By registering a student for our programs, parents/guardians acknowledge that their student may be photographed or recorded during classes, rehearsals, and performances, and that such images/videos may be used in Upbeat's marketing materials, website, and social media, unless the parent/guardian opts out in writing.
To opt out of photo/video use for your student, please email us at upbeatmusicgroups@gmail.com prior to the start of classes. We will make reasonable efforts to honor opt-out requests but cannot guarantee removal from group or wide-shot footage of public performances.
5. How We Share Information
We may share information with:

Service providers who help us operate (e.g., Wix website hosting, Google Forms/Google Sheets for registration collection and storage, payment processors, scheduling/communication tools such as Band)

Scholarship/funding program administrators, only as needed to process a family's application or verify enrollment, and only with the family's consent

Farmington City / Farmington Arts Center, limited to information necessary to coordinate facility use, if applicable

Legal authorities, if required by law, subpoena, or to protect the safety of a student or staff member
Registration information (including parent/guardian contact details, student names, ages, and program selections) is collected through Google Forms and stored in Google Sheets. Access to this data is restricted to authorized Upbeat staff. Google's own handling of this data is governed by Google's Privacy Policy (policies.google.com/privacy), in addition to this policy.
We do not share student or family information with third parties for their own marketing purposes.
6. Cookies and Website Analytics
Our Site, built on Wix, may use cookies and similar technologies to operate properly and understand how visitors use the Site. You can control cookies through your browser settings. Disabling cookies may affect some Site functionality.
7. Data Security
We take reasonable steps to protect personal information from unauthorized access, use, or disclosure. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.
We currently use a business email address (upbeatmusicgroups@gmail.com) for inquiries and submissions; we encourage families not to send sensitive payment information (such as full card numbers) via email.
8. Data Retention
We retain student and family information for as long as necessary to provide our programs, maintain accurate records, comply with legal/scholarship vendor obligations, and for a reasonable period afterward for record-keeping purposes. You may request deletion of your information by contacting us, subject to any legal or contractual retention requirements (e.g., scholarship program documentation).

Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Upbeat Performing Arts Academy website (the "Site") and your enrollment in any Upbeat Performing Arts Academy ("Upbeat," "we," "us," "our") class, program, ensemble, or performance (collectively, "Programs"). By using the Site or registering for a Program, you ("you," "parent/guardian," "Customer") agree to these Terms on behalf of yourself and your student.
If you do not agree to these Terms, please do not use the Site or register for our Programs.
1. Eligibility & Enrollment

Programs are designed for students ages 5–18. Registration must be completed by a parent or legal guardian.

Enrollment is confirmed upon receipt of a completed registration form and applicable registration fee, and is subject to class availability.

Some classes (Intermediate and Advanced levels) require a placement video audition prior to enrollment, as described on our Placement & Auditions page. The Beginning Instrumental Program does not require an audition.

We reserve the right to adjust, combine, split, reschedule, or cancel classes based on enrollment numbers, and will make reasonable efforts to notify affected families as early as possible.

2. Tuition & Fees

Current tuition rates, registration fees, building rental fees, and applicable discounts are posted on our Tuition & Calendar page and are subject to change for future semesters with reasonable advance notice.

The registration fee is non-refundable, except as described in our [Refund & Withdrawal Policy].

Tuition is due according to the schedule communicated at registration. Failure to make timely payment may result in suspension or removal from class.

Sibling discounts, Farmington resident discounts, and scholarship/tuition assistance are subject to the eligibility terms posted on our Tuition page and may not be combined beyond what is explicitly stated.

Families applying for tuition assistance through state or third-party scholarship/funding programs (e.g., Utah Fits All Scholarship, Carson Smith Opportunity Scholarship, OpenEd, Harmony Education) are responsible for meeting that program's own eligibility, application, and documentation requirements. Upbeat's role is limited to acting as a registered vendor where applicable and does not guarantee award amounts, approval, or timing, which are determined solely by the administering program.
3. Class Schedule, Attendance & Materials

Class times, locations, and instructors are posted on our Classes & Schedule page and may be adjusted based on enrollment.

Students are expected to bring required materials (instrument, method book, etc.) as listed for their specific class. Families are responsible for obtaining and maintaining their own instruments and materials unless otherwise stated.

Regular at-home practice is expected and is the responsibility of the student/family; Upbeat is not responsible for a student's individual progress absent consistent practice and attendance.

Classes are held at the Farmington Arts Center unless otherwise noted. Upbeat's ability to deliver classes is subject to continued availability of this facility.
4. Placement, Auditions & Performances

Placement videos and musical theater audition videos must be submitted by the posted deadlines (see our Placement page and Calendar). Late submissions may affect placement or casting availability and are not guaranteed consideration.

Casting, ensemble placement, and role assignment decisions are made at Upbeat's sole discretion based on submitted materials, current enrollment, and program needs.

Participation in concerts, recitals, festivals, and performances (including the Christmas Concert/Winter Showcase, Spring Concert, Festival of Trees, and Symphony Orchestra Festival at Lagoon) may involve specific dress rehearsal attendance requirements, ticketing, or off-site travel, which will be communicated to families in advance.
5. Cancellations & Schedule Changes by Upbeat

In the event Upbeat must cancel a class session (e.g., instructor illness, facility closure, weather), we will make reasonable efforts to reschedule the session or otherwise communicate next steps to affected families. Isolated single-session cancellations due to circumstances outside our control do not automatically entitle a family to a refund or tuition credit, except as required by law or stated otherwise in our Refund & Withdrawal Policy.
6. Code of Conduct
We expect students, parents, and guardians to treat instructors, staff, and fellow students with respect. Upbeat reserves the right to remove a student from a Program, without refund of tuition already paid for sessions attended, in cases of:

Repeated disruptive behavior that interferes with other students' learning

Failure to follow facility (Farmington Arts Center) rules

Conduct that Upbeat reasonably determines poses a safety risk to students or staff
We will make reasonable efforts to communicate concerns to families and work toward a resolution before removal, except in cases involving immediate safety concerns.
7. Photo, Video & Media Use
Participation in Upbeat Programs may involve being photographed or recorded for use in marketing, our website, and social media, as described in our [Privacy Policy]. Families may opt out by contacting us in writing as described in that policy.
8. Health, Safety & Liability

Parents/guardians are responsible for informing Upbeat of any medical conditions, allergies, or special needs relevant to their student's safe participation in classes or performances.

To the fullest extent permitted by law, Upbeat, its instructors, and staff are not liable for injuries, accidents, or loss of personal property occurring during classes, rehearsals, or performances, except to the extent caused by Upbeat's gross negligence or willful misconduct.

Upbeat strongly recommends families carry their own health/accident insurance for participating students.
9. Intellectual Property
All content on the Site — including text, graphics, logos, and images — is the property of Upbeat Performing Arts Academy unless otherwise noted, and may not be copied or reproduced without permission. Method books and other third-party materials remain the property of their respective publishers.
10. Performance Booking Inquiries
Requests to book Upbeat ensembles for outside performances are handled on a case-by-case basis, are subject to a separate written agreement covering fees, scheduling, and logistics, and are not guaranteed by submission of an inquiry alone.
11. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of our Programs shall be resolved in the appropriate courts located in Davis County, Utah.
12. Changes to These Terms
We may update these Terms from time to time. Continued enrollment or use of the Site after changes are posted constitutes acceptance of the revised Terms.

Refund Policy

This policy explains how refunds, credits, and withdrawals are handled for Upbeat Performing Arts Academy ("Upbeat") classes and programs. It works together with our [Terms & Conditions] and applies to all registrations.
1. Registration Fee
The $10 per-student registration fee is non-refundable once submitted, regardless of whether the student later withdraws, except in cases where Upbeat cancels the program entirely before it begins.
2. Withdrawing Before the Semester Begins
-
Families who withdraw before September 1st are eligible for a full refund of semester tuition and building rental fee paid, minus the non-refundable registration fee.

Beginning Band Camp fees ($20/student) are non-refundable once camp begins, but are refundable in full if cancellation occurs at least 7 days before camp starts.
3. Withdrawing After the Semester Begins
Because class spots are limited and instructors are scheduled and paid based on enrollment, tuition is not refunded on a per-session or prorated basis once a semester has begun, except as described below.

Within the first 6 weeks / 6 class sessions of a semester: families may withdraw and receive a refund for the remaining, unattended portion of the semester, minus a $25 processing fee.

After the first 6 weeks / 6 class sessions: no refund will be issued for the remainder of the semester. We understand circumstances vary, and families facing extenuating circumstances (e.g., medical issues, relocation) are encouraged to contact us directly at upbeatmusicgroups@gmail.com — exceptions may be considered at Upbeat's discretion on a case-by-case basis.
4. Classes Canceled or Combined by Upbeat

If Upbeat cancels a class entirely due to low enrollment (e.g., before the semester begins), affected families will receive a full refund of tuition and fees paid for that class, or the option to transfer to a comparable class/time, at the family's choice.

If Upbeat must combine, adjust, or change the time of a class due to enrollment, and the new arrangement does not reasonably work for a family's schedule, the family may withdraw and receive a refund as described in Section 2 or 3 above, depending on timing.

Isolated, single-session cancellations (e.g., due to weather, instructor illness, or facility closure) will be rescheduled when possible. If a missed session cannot be rescheduled, Upbeat will determine, at its discretion, whether a credit toward a future session is appropriate.
5. Sibling Discount & Bundled Fees
If one sibling withdraws from a multi-sibling enrollment, the sibling discount applied to remaining siblings' tuition will be recalculated based on the adjusted number of enrolled siblings, effective the next billing period.
6. Scholarship & Tuition Assistance Funds
For students enrolled through a third-party scholarship or funding program (e.g., Utah Fits All Scholarship, Carson Smith Opportunity Scholarship, OpenEd, Harmony Education):

Refunds related to funds paid directly by a scholarship/funding program are subject to that program's own refund and reporting rules, in addition to this policy.

Upbeat will cooperate with required reporting back to the funding program in the event of a withdrawal or refund, as required to maintain vendor compliance.

Families are responsible for understanding their specific scholarship program's rules regarding withdrawal, attendance, and fund usage.
7. Musical Theater & Performance-Specific Materials
Costume, script, or production-specific fees (if applicable) are non-refundable once materials have been ordered or assigned on the student's behalf, as these are typically non-recoverable costs for Upbeat.
8. How to Request a Withdrawal or Refund
To withdraw a student or request a refund, please email upbeatmusicgroups@gmail.com with:

Requested withdrawal date

Reason for withdrawal (optional, but helpful for our records)
Refunds, when approved, will be issued to the original payment method within 30 business days.
9. Building Rental Fee
The building rental fee is collected to cover Upbeat's cost of using the Farmington Arts Center and follows the same refund timelines as tuition, as described in Sections 2 and 3 above.
10. Discretion Clause
Upbeat reserves the right to make exceptions to this policy on a case-by-case basis, particularly in cases of documented medical emergencies, family relocation, or other significant hardship. Requests for exceptions should be submitted in writing to upbeatmusicgroups@gmail.com.
